Policies
Using this site
The website yhsh.com.br presents YhSh Real Estate Ltd., its services, properties and informative content. Viewing the pages and sharing public links are permitted for lawful purposes, with respect for good faith, privacy and the rights of third parties. Browsing, completing a form or making initial contact do not, in themselves, constitute a brokerage agreement, exclusivity, a property reservation or an obligation to pay. The provision of services depends on a separate agreement, with prior definition of the scope, fees, responsibilities and commercial terms. Real estate activities comply with Law No. 6.530/1978, Decree No. 81.871/1978, the Professional Code of Ethics approved by COFECI Resolution No. 326/1992 and the other applicable rules of the COFECI/CRECI System, including the oversight and advertising requirements of CRECI-SC. Property advertising must have written authorisation from the owner or an authorised representative and appropriate professional identification. We seek to provide clear and up-to-date information on prices, availability, features and charges, preserving the legal effects of offers and the rights guaranteed by the Consumer Protection Code. Editorial content is informative and does not replace individual legal, financial, accounting or technical analysis. Using the site for fraud, harassment, discrimination, sending malicious code, overloading services, abusive data collection, obtaining credentials or unauthorised access to the administrative dashboard, database and private files is prohibited. Attempts to bypass security controls, break encryption, decipher protected information or exploit vulnerabilities without express authorisation are also prohibited. The brand, business name, logos and owned or licensed materials may not be appropriated or used to suggest a non-existent affiliation or authorisation, subject to the rights that actually exist, Laws No. 9.610/1998 and No. 9.279/1996, applicable licences and legally permitted uses. Proportionate blocking and evidence preservation measures may be adopted in response to abuse, without prejudice to any applicable legal action.
Data and enquiries
To request contact through the form, a name, telephone or WhatsApp number and an indication of your interest are required; email and message are optional. During assistance, the related property, the source of the request, the language, interactions, the person responsible, the negotiation stage and information needed for follow-up may be recorded. These data are used to respond to the request, take pre-contractual steps requested by the data subject and, where an agreement is entered into, perform the agreed services, pursuant to Article 7, V, of Law No. 13.709/2018, the General Personal Data Protection Law. The form records the request. There is no public submission of documents through the site; documents required for negotiations are requested during assistance, through a channel indicated by the team. Due diligence must be proportionate to the type of transaction and the risks identified, including an up-to-date property registry record, verification of encumbrances and registry annotations, the identity and CPF of owners and representatives, powers of representation and marital status documents where relevant. Certificates or evidence of compliance with IPTU and other municipal debts, a declaration of settlement of condominium charges and supplementary checks may also be requested. For a corporate owner, proof of CNPJ registration and registration status, incorporation documents, representatives' powers, identification of beneficial owners and relevant tax, employment and judicial certificates may be necessary. Proof of CNPJ registration does not replace a tax clearance certificate. The instruments used in brokerage are checked beforehand by qualified professionals, within their areas of competence; legal matters and drafts requiring legal advice must be submitted to a lawyer, and accounting or technical matters to the competent professional. Due diligence does not constitute an absolute guarantee of the absence of liabilities, hidden defects or fraud and does not remove the duty to explain known risks. Leases covered by Law No. 8.245/1991 comply with the legal obligations of landlords and tenants, charges, guarantees, inspections and applicable rights. Brokerage follows Articles 722 to 729 of the Civil Code, with fees explained and agreed in advance. Direct or subsequent completion of the transaction does not automatically exclude commission arising from proven brokerage, pursuant to Article 727; written exclusivity and its exceptions follow Article 726. There is no automatic charge for a viewing or click, nor any presumption of fraud. Any charge takes into account the agreement, the outcome, effective participation in bringing the parties together, and good faith, without coercion or a penalty created solely by these policies.
Services and protection
Information protection combines technical and organisational measures appropriate to the risk, including role-based access restrictions, administrative authentication, protection of private files and additional encryption of private fields. Production deployment uses HTTPS connections. Some third-party services used to maintain the website may process technical connection information. Awareness of this policy does not amount to specific consent for any transfer of data. Information on recipients and protective measures may be requested through the privacy channel legal@yhsh.com.br. Strictly necessary data may be shared with parties to the negotiation, representatives, partner brokers, lawyers, accountants, banking correspondents, financial institutions, notarial and registry offices and other relevant professionals, for stated purposes and on an appropriate legal basis. Each professional acts within their remit, with responsibilities and costs explained in advance; a referral does not guarantee credit approval, profitability or completion of the transaction and does not authorise tied selling. Legal and regulatory obligations, the defence of rights and credit protection rely on the relevant legal bases. Security and abuse prevention may rely on legitimate interests, subject to an assessment of necessity and the data subject's rights. Law No. 9.613/1998 and COFECI Resolution No. 1.336/2014, as amended, require identification, records and reporting in the activities covered. Transactions or proposals falling within the applicable criteria must be reported to COAF in accordance with the applicable criteria and deadlines, while preserving confidentiality. Where required and in the absence of reportable events in the previous year, the Non-Occurrence Communication must be submitted to the COFECI/CRECI System by 31 January of the following year, subject to regulatory changes. This declaration does not mean that there were no sales and does not replace tax obligations. Suspected data exposure may be reported to legal@yhsh.com.br; incidents will be assessed and any required notifications will follow Article 48 of the LGPD and ANPD regulations.
Necessary cookies and resources
In this version, the site uses only resources intended for operation, administrative authentication and security, without behavioural advertising cookies or visitor analytics tools for marketing. The selected language forms part of the page path and does not depend on an advertising cookie. When "Got it" is pressed, a functional preference is saved in the tab's session storage to prevent the notice from repeating during navigation and page refreshes. This preference does not record authorisation for tracking and does not constitute general consent to data processing. Anti-spam verification may process technical information, such as browser and connection signals, to identify abusive requests and protect the services. Servers and infrastructure providers may also process technical logs necessary for operation, security or compliance with a legal obligation. Necessary resources are assessed according to their purpose, proportionality and legal basis; they are not presented as fictitious optional categories. The absence of marketing tools does not mean the absence of all technical processing. External services accessed through links have their own policies and may use cookies in their environments. The future inclusion of analytics, pixels, advertising or other non-essential resources will depend on prior assessment, updated information and the availability of a choice mechanism where legally required. The "Got it" button serves only to dismiss this version's informative notification.
Retention and your rights
Personal data are retained for the time necessary for the legitimate purposes of assistance and compliance with applicable obligations, observing the LGPD principles of purpose, suitability, necessity and transparency. Contacts that do not result in an agreement or transaction are not automatically subject to the same retention period as records of completed transactions. Once the purpose of assistance has ended, your data must be reviewed for deletion or anonymisation, except where retention is necessary and justified by a legal obligation, the defence of rights or another permitted ground. We do not treat the mere existence of a record as justification for indefinite retention. Registrations and records covered by Article 13 of COFECI Resolution No. 1.336/2014 must be retained for at least five years from completion of the transaction. Tax and accounting documents follow their own time limits, including Article 195, sole paragraph, of the National Tax Code; agreements and evidence may require additional retention due to limitation periods, pending proceedings or specific obligations. Access logs subject to Article 15 of the Brazilian Internet Civil Rights Framework observe the statutory period of six months, except for permitted extensions. During retention, access remains restricted to justified purposes. Under Articles 18 to 20 of the LGPD, the data subject may request confirmation of processing, access, correction, information on sharing, anonymisation, blocking or deletion of unnecessary, excessive or unlawfully processed data, portability in accordance with regulations, withdrawal of consent and deletion in the cases provided by law. They may also obtain information on the possibility and consequences of not consenting, object to processing without consent that breaches the LGPD and request a review of exclusively automated decisions affecting their interests. To request deletion of a data item or end assistance, send your name and the telephone number or email used to legal@yhsh.com.br, stating your request, without attaching unnecessary documents. Identity may be confirmed by proportionate means. We will inform you of the action taken or the justification for any retention, including its purpose and time-limit criteria. Confirmation and access follow Article 19, including a complete statement within 15 days, subject to applicable specific rules; other requests follow their relevant time limits. Requests are free of charge. Deletion takes into account the systems under our control and legal limits, with notification to recipients where required. Any existing backups follow documented cycles, without commercial reuse of deleted data.
External links
The site provides links to WhatsApp, email, Instagram, Facebook, Google and other third-party services. By using them, visitors interact with environments that have their own terms of use, privacy policies, cookies and security procedures. Contact buttons may prepare a message and include the link to the property viewed, but sending it depends on the user's action in the corresponding application. YhSh does not fully control the availability, content or data processing carried out by these services. Providing a link does not represent an absolute guarantee regarding all content, features or services at the destination. We do not assume responsibility for acts exclusively attributable to third parties, within the limits of the law, without excluding responsibility for our own failures, negligent referrals or other legally applicable duties. Personal information shared directly with external platforms may remain subject to the obligations and policies of their respective controllers; requests concerning such processing may require contact with the responsible service. Before sending documents, engaging services or making payments, confirm the authenticity of the recipient and instructions through YhSh's official channels. Bank account changes or payment requests received by message must be independently verified. Our team does not request banking passwords or authentication codes. Suspicious links, pages imitating the brand or misuse of the company's identity may be reported to legal@yhsh.com.br

There is no exclusion of responsibility for our own failures or advance waiver of non-waivable rights.
